You may create an online user profile consisting of a username, password, and other information that you provide. It is a condition of your use of the Site that all the information you provide on the Site is correct, current and complete. Any personal information you provide will be subject to Calibra-T's Privacy Notice, and you consent to all actions Calibra-T takes with respect to your information consistent with Calibra-T's Privacy Notice.
You understand and agree that you are solely responsible for maintaining the privacy and security of your usernames and passwords, and for any activity associated with your online user profile. While these Terms will govern your use of this Site, separate agreements will govern provision of Financial Services. You understand and agree that the terms and conditions of these other agreements for Financial Services solely govern your use of such Financial Services – these Terms shall only govern your use of this Site.
You understand and agree that Calibra-T or its licensors hold all right, title, and interest to the Site and all intellectual property, material, content, features, or services provided through the Site, and the design, selection and arrangement thereof. Calibra-T may, from time to time, change these Terms with or without notice to you. It is your responsibility to review the most current version of these Terms prior to use of the Site. All changes are effective immediately when posted and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
You understand and agree that all members of Calibra-T Financial Group are third-party beneficiaries of these Terms. This includes Calibra-T, Calibra-T Asset Management, Calibra-T Securities, Calibra-T Analytics, and Calibra-T Global, Calibra-T Capital, and each of their affiliate organizations. As such, any Calibra-T Financial Group entity or member organization (collectively, "Calibra-T Affiliates") any rights provided herein also inure to the benefit of Calibra-T Affiliates, and any Calibra-T Affiliate may rely upon these Terms and enforce any rights provided to Calibra-T herein.
You may link to Calibra-T's homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of associate, approval or endorsement on Calibra-T's part without Calibra-T's express written consent. You agree to cooperate with us in causing any unauthorized linking immediately to cease. Calibra-T reserves the right to withdraw linking permission without notice.
These Terms and your use of this Site are subject by the laws of the State of California without regard to its conflict of laws provisions. Any dispute arising from or related to these terms may only be brought in the courts located in Santa Clara County, California. Although you may access this Site in other states or countries, your use of this Site still subjects you to the exclusive jurisdiction of these courts. These Terms are provided to you in any language other than English are for your convenience only; the English-language version will govern use of this Site.

You also understand and agree no waiver of by Calibra-T of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Calibra-T or any Calibra-T Affiliates to enforce their rights under these Terms or at law will not be considered a waiver of such rights.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
These Terms and the Calibra-T Privacy Notice constitute the entire agreement between you and Calibra-T regarding your access and use of the Site, and may be modified or changed only upon separate written agreement provided by Calibra-T. These Terms supersede any previous terms, conditions, or agreements of the parties regarding the use of the Site. Other Calibra-T Web sites may provide changes or additions to these Terms.
